IMPORTANT: USAGE INSTRUCTIONS & DISCLAIMER

By entering the lounge, using a NAIPO armchair, or booking through our website, you expressly accept the following terms of use.

1. OPERATOR & CONTRACTUAL RELATIONSHIP

The operator of the lounge is Alsterwell GmbH, Oberstraße 134, 20149 Hamburg
Germany. By booking or using the lounge, a user agreement is concluded exclusively with the operator.

2. AGE RESTRICTION

Use is permitted only for persons aged 16 and over. Minors may only use the lounge when accompanied by or with the written consent of a parent or guardian. Parents are liable for their children.

3. GENERAL USE

Our massage chairs use AI-supported sensors to adapt massage functions. Body-related information (e.g., seating position, body size) is only processed temporarily – it is not stored or shared.

The application is intended exclusively for general well-being and is not a medical or therapeutic measure. It is carried out at your own risk and does not replace medical advice. NAIPO does not guarantee individual effects or subjectively expected results.

Use does not constitute medical treatment or healing treatment within the meaning of the German Alternative Practitioner Act (Heilpraktikergesetz).

4. HEALTH ADVICE

Persons with health restrictions must seek medical advice before use, especially in cases of:

• Cardiovascular diseases
• Pregnancy
• Implanted medical devices (e.g., pacemakers, neurostimulators)
• Recent surgeries or open wounds
• Acute back or disc problems
• Neurological diseases or nerve irritations

The operator does not conduct a suitability check. Guests are solely responsible for ruling out health risks.

In the event of health complaints during or after use, no medical care will be provided on site. Liability for failure to provide assistance is excluded, unless caused by gross negligence or intent on the part of NAIPO.

5. LIABILITY & ASSUMPTION OF RISK

Use of the lounge is at your own risk. The operator's liability is limited to intent and gross negligence. For simple negligence, the operator is only liable in cases of injury to life, body, or health.

Guests are fully liable for damages caused by improper use, negligence, or violations of the terms.

The operator also assumes no liability for damage to clothing, accessories, or other brought-in items, unless there is intent or gross negligence.

6. CONDUCT & HOUSE RULES

Please follow the safety and usage instructions as well as the staff's directions. The operator exercises unlimited house rights and may prohibit guests from entering or using the facilities at any time, especially in cases of:

• Improper use or damage
• Willful soiling
• Noise, disturbance, or harassment of other guests
• Bringing in and consuming alcohol, drugs, or food/drinks

In case of violations, there is no right to a refund.

7. HYGIENE & CLEANING

We recommend arriving freshly showered and in clean clothes. In case of willful or significant soiling, cleaning costs (from €49, up to €89) as well as repair costs (at least €150) may be charged. Further claims for damages remain reserved.

8. SMART-TVS & CONTENT

The Smart TVs are exclusively for playing internal company content (e.g., introductory videos, safety instructions). Private use (streaming, logging into personal accounts) is not part of the offer. Should guests nevertheless use accounts, they are responsible for logging out and data security.

9. BOOKING, RESCHEDULING & CANCELLATION

• Rescheduling or cancellation is possible up to 24 hours before the appointment; a non-refundable voucher will be issued (valid for 3 years). Refunds are excluded.
• From 24 hours before the appointment, rescheduling or refunds are no longer possible.
• A statutory right of withdrawal does not exist according to § 312g Abs. 2 Nr. 9 BGB.

The operator is entitled to cancel bookings for important reasons (e.g., safety risks, technical defects). In this case, a voucher will be issued.

10. FORCE MAJEURE & TECHNICAL FAILURES

In cases of force majeure, official orders, or technical defects, there is no right to a refund. At the operator's discretion, a rescheduling or issuance of a voucher will occur.

11. BOOKING FOR THIRD PARTIES

Bookings on behalf of third parties are only permitted if all affected persons have previously taken note of these terms. The booking guest is liable for their conduct.

12. BROUGHT-IN ITEMS

The operator assumes no liability for loss, theft, or damage to brought-in items (e.g., valuables, mobile phones, clothing), except in cases of intent or gross negligence.

13. DATA PROTECTION & VIDEO SURVEILLANCE

For bookings, personal data is processed exclusively for transaction purposes. Details can be found in our privacy policy.

The entrance area may be video-monitored for security reasons (Art. 6 para. 1 lit. f GDPR). Recordings are not passed on to third parties and are deleted according to legal requirements.

14. LANGUAGE & TRANSLATIONS

The terms of use are only available in German. Guests who are not proficient in the language must obtain a translation themselves.

15. LAW & JURISDICTION

German law applies. The place of jurisdiction is, as far as legally permissible, the registered office of the operator.

16. NO GUARANTEE OF AVAILABILITY

There is no entitlement to the continuous availability of the lounge, individual functional areas, or specific devices (e.g., a specific model of a massage chair). In case of technical failures or short-term restrictions, there is no right to a refund. In such cases, at the operator's discretion, a rescheduling or issuance of a voucher will occur.

17. PRECEDENCE OF THE WRITTEN VERSION

Only the written published version of these terms of use applies.

Oral agreements or promises – even by staff – are non-binding.

18. CONSUMER DISPUTE RESOLUTION (§ 36 VSBG)

NAIPO (Alsterwell GmbH) is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

19. SEVERABILITY CLAUSE

Should a provision be invalid, the validity of the remaining provisions remains unaffected.

The use of the lounge and all facilities is exclusively at your own risk. By booking and/or entering the lounge, you legally acknowledge all provisions.
