IMPORTANT: USAGE INSTRUCTIONS & DISCLAIMER

By entering the lounge, using a NAIPO massage chair, or booking through our website, you legally agree to the following terms of use.

1. OPERATOR & CONTRACTUAL RELATIONSHIP

The lounge operator is Alsterwell GmbH, Oberstraße 134, 20149 Hamburg
Germany. By booking or using the lounge, a user agreement is concluded exclusively with the operator.

2. AGE RESTRICTION

Use is permitted only for those 16 years of age or older. Minors may only use the lounge when accompanied by or with the written consent of a legal guardian. Parents are liable for their children.

3. GENERAL USE

Our massage chairs use AI-powered sensors to adjust massage functions. Body-related information (e.g., sitting position, height) is processed only temporarily – it is not stored or shared.

The application serves solely for general well-being and is not a medical or therapeutic measure. It is done at your own risk and does not replace medical advice. NAIPO does not guarantee individual effects or subjectively expected results.

Use does not constitute medical treatment or healing treatment within the meaning of the German Alternative Practitioner Act (Heilpraktikergesetz).

4. HEALTH INFORMATION

Persons with health restrictions must seek medical advice before use, especially in cases of:

• Cardiovascular diseases
• Pregnancy
• Implanted medical devices (e.g., pacemakers, neurostimulators)
• Recent surgeries or open wounds
• Acute back or disc problems
• Neurological diseases or nerve irritations

The operator does not conduct suitability checks. Guests are solely responsible for ruling out health risks.

In the event of health complaints during or after use, no medical care will be provided on-site. Liability for failure to render assistance is excluded, unless caused by gross negligence or intent on the part of NAIPO.

5. LIABILITY & ASSUMPTION OF RISK

Use of the lounge is at your own risk. The operator's liability is limited to intent and gross negligence. For simple negligence, the operator is only liable for injury to life, body, or health.

Guests are fully liable for damages caused by improper use, negligence, or violations of these terms.

The operator also assumes no liability for damage to clothing, accessories, or other brought items, unless intent or gross negligence is involved.

6. CONDUCT & HOUSE RULES

Please follow the safety and usage instructions as well as the staff's directions. The operator exercises unrestricted house rights and may deny guests access or use at any time, especially in cases of:

• Improper use or damage
• Willful soiling
• Noise, disturbance, or harassment of other guests
• Bringing and consuming alcohol, drugs, or food/drinks

In case of violations, there is no right to a refund.

7. HYGIENE & CLEANING

We recommend arriving freshly showered and in clean clothing. In the event of willful or significant soiling, cleaning costs (from €49, up to €89) as well as repair costs (at least €150) may be charged. Further claims for damages remain reserved.

8. SMART TVs & CONTENT

The Smart TVs are exclusively for displaying internal operational content (e.g., introductory videos, safety instructions). Private use (streaming, logging into personal accounts) is not part of the offering. If guests nevertheless use accounts, they are responsible for logging out and data security.

9. BOOKING, REBOOKING & CANCELLATION

• Rebooking or cancellation is possible up to 24 hours before the appointment; a non-cashable voucher will be issued (valid for 3 years). Refunds are excluded.
• No rebooking or refund is possible within 24 hours before the appointment.
• A statutory right of withdrawal does not exist according to § 312g Abs. 2 Nr. 9 BGB.

The operator is entitled to cancel bookings for important reasons (e.g., safety risks, technical defects). In this case, a voucher will be issued.

10. FORCE MAJEURE & TECHNICAL FAILURES

In cases of force majeure, official orders, or technical defects, there is no right to a refund. At the operator's discretion, a rebooking or the issuance of a voucher will take place.

11. BOOKING FOR THIRD PARTIES

Bookings on behalf of third parties are only permitted if all affected persons have previously taken note of these terms. The booking guest is liable for their conduct.

12. BROUGHT ITEMS

The operator assumes no liability for loss, theft, or damage to brought items (e.g., valuables, mobile phones, clothing), except in cases of intent or gross negligence.

13. DATA PROTECTION & VIDEO SURVEILLANCE

When booking, personal data is processed exclusively for transaction purposes. Details can be found in our privacy policy.

The entrance area may be video-monitored for security reasons (Art. 6 Abs. 1 lit. f GDPR). Recordings are not passed on to third parties and are deleted according to legal requirements.

14. LANGUAGE & TRANSLATIONS

The terms of use are available only in German. Guests who are not proficient in the language must arrange for a translation themselves.

15. LAW & JURISDICTION

German law applies. The place of jurisdiction, insofar as legally permissible, is the operator's registered office.

16. NO GUARANTEE OF AVAILABILITY

There is no claim to the continuous availability of the lounge, individual functional areas, or certain equipment (e.g., a specific model of a massage chair). In the event of technical failures or short-term restrictions, there is no right to a refund. In such cases – at the operator's discretion – a rebooking or the issuance of a voucher will take place.

17. PRECEDENCE OF THE WRITTEN VERSION

Only the written published version of these terms of use applies.

Verbal agreements or promises – even by staff – are non-binding.

18. CONSUMER DISPUTE RESOLUTION (§ 36 VSBG)

NAIPO (Alsterwell GmbH) is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

19. SEVERABILITY CLAUSE

Should any provision be invalid, the validity of the remaining provisions remains unaffected.
